Terms of Service

1. Introduction
Welcome to EnFlash ("EnFlash," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our websites, applications, and related services (collectively, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Who we are
EnFlash operates a two-sided marketplace that connects clients with creatives (including photographers, videographers, and related professionals) for bookings, payments, messaging, and delivery of creative work. EnFlash is not a party to the underlying service agreement between clients and creatives unless expressly stated in a separate written agreement.
3. Definitions
- "Client" means a user who books or pays for creative services through the Services.
- "Creative" means a user who offers services, manages availability, and fulfills bookings through the Services.
- "User" means anyone who accesses or uses the Services (Clients and Creatives included).
- "Content" means text, images, portfolio materials, messages, deliverables, and other material submitted through the Services.
4. Accounts and eligibility
You must provide accurate account information and keep it current. You are responsible for safeguarding your credentials and for activity under your account. Notify us promptly at support-terms@enflash.co if you suspect unauthorized access.
5. Acceptable use
You agree not to misuse the Services. Without limitation, you must not:
- Violate applicable laws or third-party rights.
- Harass, defraud, or impersonate others.
- Upload malware, probe systems without authorization, or interfere with the integrity or performance of the Services.
- Circumvent payment, fee, or safety mechanisms where applicable.
- Scrape or aggregate data from the Services in breach of these Terms or technical restrictions.
6. Bookings, payments, and marketplace role
Bookings may be subject to package descriptions, schedules, cancellation rules, and fees presented at checkout or on profiles. Payment processing and payouts may be handled through third-party providers (for example, payment processors). EnFlash may charge platform fees as disclosed in the product. Disputes between Clients and Creatives regarding the creative work itself should be resolved between those parties where applicable; EnFlash may offer tooling or support as described in the product but does not guarantee any particular outcome unless required by law.
7. Intellectual property
Creatives generally retain rights in their own creative works subject to any license granted to the Client in the booking or deliverables flow. EnFlash may receive a limited license to host, display, and operate the Services with respect to Content users submit (for example, profiles and portfolio previews). Do not upload Content you do not have rights to use.
8. Disclaimers and limitation of liability
The Services are provided "as is" and "as available." To the fullest extent permitted by law, EnFlash disclaims implied warranties (such as merchantability or fitness for a particular purpose) except where such disclaimers are not permitted. To the fullest extent permitted by law, EnFlash will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the Services.
9. Changes
We may update these Terms from time to time. We will post the revised Terms and update the "Last updated" date. Continued use after changes become effective constitutes acceptance unless applicable law requires additional steps.
10. Governing law
These Terms are governed by the laws of Spain, excluding conflict-of-law rules that would apply another jurisdiction's laws, unless mandatory consumer protections in your country say otherwise.
11. Cookies, analytics consent, and the cookie_consent preference
EnFlash uses cookies and similar technologies to run the Services—for example, to keep you signed in (authentication cookies managed with our auth provider), protect accounts, remember operational preferences where applicable, and support features such as referrals or session continuity. Some of these are strictly necessary for security and core functionality and do not depend on optional analytics consent.
Where required (for example, for visitors we infer are in the European Economic Area based on network signals such as geo headers from our hosting provider), we ask whether you agree to optional analytics-related tags . When you agree, we enable measurement that helps us understand aggregated usage of EnFlash—such as page views, navigation paths, coarse technical context (for example browser/device category), and rough interaction patterns—so we can improve reliability, prioritize fixes, and shape the product roadmap. We configure consent signals so that advertising-related storage types are aligned with the same preference where applicable.
We store your choice in a first-party browser cookie named cookie_consent with values true or false . That cookie's purpose is to remember whether you have accepted or declined optional analytics for your browser
for a limited period, so we do not repeatedly show the same prompt. It does not need to contain personal identifiers
by itself; combined with other logs it could form part of technical records processed when you use the Services.
If you decline optional analytics, we aim to respect that choice for measurement tags covered by that banner; core functionality of EnFlash should continue to operate with necessary cookies. Details may evolve as we ship features—check this section periodically.
